The only ocassion I have seen of something like this is a Marine I had was a Cpl and NJP'd for suspected DUI while the case was still pending. He was busted to E3 a week before he was supposed to pin on Sgt. He ended up EAS'ing a few months later. His DUI case was tossed shortly after because of a faulty breathalyzer that created a false positive. We were able to get not only his rank of Cpl restored but also his promotion to Sgt and all the back pay he missed along the way. This was a special case.
