If a soldier fails two PT tests, but the 2nd PT test exceeds 90 days, will that cancel out a chapter packet?

I have a soldier who failed 2 record PT tests and was initiated a chapter packet but the 2nd test was taken after the 90 day per regulation it has to be no later then 90days. Does anyone know what happens to the packet if the 2nd PT test was taken after the 90days and can you please site the regulation/regulation canceling the chapter packet. Thank you for your help

I keep reading the regulation and all I see and read is “can not exceed 90 day” I’m going threw everything but maybe I’m just not looking in the right places if you can lead me or give me an idea of where I should look I would really appreciate it

(5) Soldiers requiring makeup testing will be scheduled in accordance with the unit standard operating procedures.
(6) Soldiers who fail a record APFT for the first time or fail to take a record APFT within the required period will be flagged in accordance with AR 600–8–2. In the event of a record test failure, commanders may allow Soldiers to retake the test as soon as the Soldier and the commander feel the Soldier is ready. Soldiers without a medical profile will be retested no later than 90 days following the initial APFT failure. Reserve component Soldiers not on active duty and without a medical profile will be tested no later than 180 days following the initial APFT failure.
(7) If a Soldier fails to meet the physical readiness standards in FM 7–22, the unit commander will remove the Soldier from parachute, diving, and flight crew status. This action will be taken to ensure the safety of that Soldier and other unit members.

I know that reserves has up to 180 days for re-test per regulation.

Has there ever been an answer on this? I have the same question about what happens if the two apft's were more than 90 days apart. Does that nullify the chapter possibility? Obviously the soldier still needs to pass, but does this give another chance?
