As a former Commander, I know that we always consider in Judicial, Nonjudicial and Administrative actions Manners of Extenuation and Mitigation. I suspect do the same in other US systems. As was already stated, I am sure his service record, his service to the nation, and him fixing Iraq, were all taken into account. <br /><br />You are correct, Officers vs. Enlisted are always handled differently, as the rules are different by law. I am not saying agree with this part, but the rules are different. Reducing an officer in rank or removing them from active duty is not the same process, regulation, etc as we use for enlisted Soldiers. Any service member who commits adultrey should be promptly stripped of any and all security clearance. They can not be trusted, someone who cheats on their spouse will consistently place their own wants above all the welfare of others. There is a reason it is punishable by up to five years imprisonment under UCMJ.
