The laws also provide for quick hearings and due process. According to the article California is one of the five states that allow this seizure. It also states that it has to be ordered by a judge. Though in the states listed, I doubt that a local judge would not sign off on it. It also states that it is a TEMPORARY seizure when someone poses a threat to themselves or others. What I want to know is first off, what burden of proof is required for such a seizure to occur, how long is temporary, what process is in place for a person who has this action taken to redress the issue? I know when purchasing a firearm, they ask &quot;under penalty of perjury&quot; if a person is addicted to drugs or alcohol.
