Sgt Adrian Jones 3511064 <div class="images-v2-count-0"></div>So I just saw on Fox News this &quot;Red Flag&quot; states where authorities can seize firearms if they believe a person is a threat to themselves or the public. Does anyone know of anyone that this has happened to, I live in one the Red Flag states. I can&#39;t wait to move to Texas or Cali(also a red flag state probably not moving there now). Does anyone know of anyone who had their firearms seized? 2018-04-04T09:00:46-04:00 Sgt Adrian Jones 3511064 <div class="images-v2-count-0"></div>So I just saw on Fox News this &quot;Red Flag&quot; states where authorities can seize firearms if they believe a person is a threat to themselves or the public. The laws also provide for quick hearings and due process. It&#39;s much better to live in a state where authorities have no ability to seize weapons until after they are used. /Sarcasm Response by LTC Private RallyPoint Member made Apr 4 at 2018 10:43 AM 2018-04-04T10:43:23-04:00 2018-04-04T10:43:23-04:00 SFC Private RallyPoint Member 3511653 <div class="images-v2-count-0"></div>In Cali it depends on the county you move to <a class="dark-link bold-link" role="profile-hover" data-qtip-container="body" data-id="342387" data-source-page-controller="question_response_contents" href="/profiles/342387-sgt-adrian-jones">Sgt Adrian Jones</a>. According to the article California is one of the five states that allow this seizure. It also states that it has to be ordered by a judge. Though in the states listed, I doubt that a local judge would not sign off on it. It also states that it is a TEMPORARY seizure when someone poses a threat to themselves or others. What I want to know is first off, what burden of proof is required for such a seizure to occur, how long is temporary, what process is in place for a person who has this action taken to redress the issue? I know when purchasing a firearm, they ask &quot;under penalty of perjury&quot; if a person is addicted to drugs or alcohol. So the background check is already being enhanced to reduce the likelihood of an unstable person from acquiring a firearm through legal channels.<br /><a target="_blank" href="https://www.washingtonpost.com/national/health-science/five-states-allow-guns-to-be-seized-before-someone-can-commit-violence/2018/02/16/78ee4cc8-128c-11e8-9570-29c9830535e5_story.html?utm_term=.4d9cb8749984">https://www.washingtonpost.com/national/health-science/five-states-allow-guns-to-be-seized-before-someone-can-commit-violence/2018/02/16/78ee4cc8-128c-11e8-9570-29c9830535e5_story.html?utm_term=.4d9cb8749984</a> <div class="pta-link-card answers-template-image type-default"> <div class="pta-link-card-picture"> <img src="https://d26horl2n8pviu.cloudfront.net/link_data_pictures/images/000/278/784/qrc/KMZJV4QS24I6RFLQFHEYGBJV4U.jpg?1522859702"> </div> <div class="pta-link-card-content"> <p class="pta-link-card-title"> <a target="blank" href="https://www.washingtonpost.com/national/health-science/five-states-allow-guns-to-be-seized-before-someone-can-commit-violence/2018/02/16/78ee4cc8-128c-11e8-9570-29c9830535e5_story.html?utm_term=.4d9cb8749984">Five states allow guns to be seized before someone can commit violence</a> </p> <p class="pta-link-card-description">Measures to let police or family members ask a judge to block someone’s access to firearms have been proposed in 18 other states.</p> </div> <div class="clearfix"></div> </div> Response by PO3 Steven Sherrill made Apr 4 at 2018 12:35 PM 2018-04-04T12:35:11-04:00 2018-04-04T12:35:11-04:00 SGT Dave Tracy 3511828 <div class="images-v2-count-0"></div>I think most &quot;Red Flag&quot; laws are fairly new (at least the modern version of Red Flag type laws) historically speaking.
