The Obama Administration got back in the face of Texas Governor Greg Abbott and the other governors who said they would not accept Syrian refugees in their states. The governors were told they must take the Syrian refugees whether they want to or not. The move by the Office of Refugee Resettlement could lead to yet another lawsuit filed by states against the federal government.

Yes I knew about this. The administration is using the Refugee Act of 1980 for the basis of their argument. This law has withstood previous challenges because our government is not singling out a state for the resettlement of the refugees.

Based on the open source information available, my opinion is that we have more to fear from terrorists either sneaking in through our northern and southern borders or using the mishmash of visa programs that the U.S. has.

The vetting process of the refugee appears strong and thorough. I think taking in refugees is the right thing to do. There are many Lebanese, Egyptian and Moroccan immigrants that have taking residency in my region and they have been a great addition to the communities. Many are also Christian, as not all from Arab areas are Muslim.

If we believe in the Constitution and many of us purport to do, then we must acknowledge the fact that Federal > State. So this refugee resettlement program is a Federal directive that states can't refuse but can implement actions to impede. But with our political divisions the way they are today most will say to hell with the Constitution so long as this POTUS is the one in charge.

Well, that would be the constitution in action. "When push comes to shove, the federal government has both the plenary power and the power of the 1980 Refugee Act to place refugees anywhere in the country, Legally, states have no authority to do anything because the question of who should be allowed in this country is one that the Constitution commits to the federal government."

The dealio on how the feds can dictate to the states lies in the 14th amendment, which pretty much trumps (har har) the 9th and 10th.

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Section 2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.

Section 3. Our governor here in Tennessee is one of the ones fighting Obama over this. We have already had so-called "refugees" dumped here in the past and the results have not been good. The state may not be able to block them but the state doesn't have to cooperate.

COL Mikel J. Burroughs - Mikel; As I read it LEGALLY the Federal government has the power to do exactly what it said it would do.

From a POLITICAL point of view, forcing the States to do what they don't want to do (even if the States are acting irrationally) is NOT a good thing to do.

On the other hand, if Mr. Obama carries his plan forward he will be decried as "dictatorial" while if he takes the views of the States into account he will be decried as "weak".

I do not agree that we here in Texas should be forced to accept unvetted refugees.
I just arrived back from Europe where they have a huge crisis and crime from the influx of refugees
It is high time that we worried more about taking care of our honorablily discharged veterans

Why were our Politicians in Texas elected to the positions they have? Is this not in the scope of their duties to regulate what happens in their respective states? This is actually quite simple; our Feds need to stay the hell out of this. Current day, we as a country really need to begin taking care of our own folks- let us begin with our Wounded Warriors, their health care etc...
How do we know for certain, considering our current immigration issues and terrorist issues- the Mexican border for example, who is actually entering our country, what their true intent is and how the hell will we take care of these folks after they arrive? I think we as the American people have had enough with these Politicians we now have in positions of power and seem to forget who put them there and why they are there- especially those in Washington DC. Our current Politicians in Washington DC., seem to have broken our country into two (2) completely different Nations- one (1) Nation is Washington DC., proper while the other is outside the belt way- North, South, East and West. The fix for our high and mighty Politicians? Term limits! We, the American people need to take our country back! God bless America and God bless our Military! Remember- Silence = consent or agreement while non action is just wrong! HOOAH!
