Is the ETP to travel to Physical Therapy, OCS, could you clarify that. Ok, waiting 2 months for a waiver or ETP from the CG? Yes, sometimes in the Reserves depending on classes you may have to await a year for school. Have you talked to your Schools NCO? You can lookup class dates in ATRRS and submit those dates to your schools NCO. They may be full or not available. Did your chain of command think you were going to beam there? Worst case, you didn't get permission to "travel" and being a Reservist probably weren't on orders to be anywhere else either, so who's going to hem you up for traveling if you are not on orders to be anywhere?<br /><br />If you are on orders to be somewhere, get yourself there, and the ETP will follow. If push comes to shove somewhere IG and JAG will hash out the conflicts of ordering a soldier to a place of duty and not providing the required ETP for the semantics of getting to the place of duty. <br /><br />What I'm reading between the lines here is you missed reporting to OCS. That will be interesting to try and fix (if I read that correctly). <br /><br />When I commissioned into the USAR (direct from SGT) I was given 6 months to complete my commissioning medical exam before the appointment window expired. HRC didn't approve my medical and all the back and forth nonsense until the VERY LAST DAY of those 6 months!!!!!! Then magically included in my commissioning paperwork someone with powerful authority just fixed EVERYTHING with ONE STROKE of the pen, and wrote a FINAL NO NONSENSE memo. <br />***ALL WAIVERS APPROVED***<br /><br />Then as a Direct Commission I was a 2LT without any OCS nonsense. POOF the officer fairy granted me my Butter Bar, but I still had to go to BOLC and become branch qualified. I had a BOLC school date, but not actual orders in hand to travel there. I'm looking at the calendar and looking at the travel distance and the math didn't look good. <br /><br />I was a day out on the road before I had my orders in hand. Otherwise I would have been late getting to BOLC. Say I never got orders. You are responsible to ensure your physical is valid through your class completion date. You have no options other then to redo your physical and try and be slotted for another OCS course. You requested another ETP, and it was denied several times. While that may suck, that is how it works. The Commander must assume that risk, which is exactly what an ETP is. If he did not agree with it, he will refuse to sign the ETP, as it is his risk to assume.<br /><br />I understand you may not like that, but that's regulation.<br /><br />You want to get a class date, but can't because of a misdiagnosis. You must wait for another ETP to correct this issue, but want to sue? You need to wait for the ETP to come back and either move forward with a class at a later date, or not. <br /><br />P.S. your actions and lack of bearing are VERY unbecoming of the NCO Corps.
