Bowe Bergdahl, the U.S. soldier who was released in a prisoner exchange in Afghanistan for five Taliban detainees, wound up in the middle of a pot raid earlier this week in northern California.

Enlisted don't actually have a "Conduct Unbecoming" (Art 133) Charge, and are usually hit with the General Article (Art 134) instead.

How would you like to be whoever is getting to manage him? There are things to be thankful for and not being tasked with that is one of them. Why is he on leave? Isn't he charged with desertion and endangering the live of soldiers, misbehavior before enemy combatants, endangering the safety of command, unit or place...?

They let him go so there wasn't anything to prove he was doing anything wrong. I will keep my feelings about this guy to myself but regardless, he is innocent until proven guilty beyond a reasonable doubt by a jury of his peers. The burden of proof is on the state and absent that, he shouldn't be charged for that. The desertion charge, well lets just say I'll watch and eat popcorn.

CSM Michael J. Uhlig If I'm guessing right we have the same feeling about deserters and this particular situation. He deserves what every other soldier who has deserted in our military has received and nothing less. If he now has committed another crime then he should pay the price for that as well. I think this young man has received too many breaks as it is. Just my opinion.

CSM, you should see how many people in the state of Idaho (especially in Pocatello where there are A LOT of combat vets), that turned around and changed their positive opinion of this cat. Some people couldn't throw their "Release Bergdahl" button pins fast enough.

He deserves to be convicted of desertion and confined to Ft. Leavenworth for a long stretch. The odds of this administration enforcing the law in his case are minimal however; it won't even keep hardened terrorists in prison despite the damage they will do to us after being released.

How he "innocently" ended up on a pot farm while on leave is a question that needs to be investigated more fully, IMHO.

Once again everybody on the site is going to get all excited and worked up, never realizing that most of the people who have been convicted of desertion in the military during the war on terror have not served prison time, or their sentence has been extremely light only a few months. Having spent five years in captivity there is no judge or jury that is going to sentence him to a lengthy prison sentence.

Also one of the disadvantages of our Congress utilizing authorizations for military force rather than declarations of war is that the United States has not been at war since World War II. This means that the maximum prison sentence he can expect is five years.

MAJ Private RallyPoint Member - I haven't been following this guy's career. I know he was accused of desertion and causing the deaths of a number of individuals sent out to search for him. What was the outcome of these allegations? Quite apart from his military criminal history - why is being present somewhere around a marijuana grower's site in california considered to be news of any kind. Whatever happened to "restriction to quarters" area ? He seems to have too much unrestricted freedom while awaiting his court martial. I see him in a pic where he saluted after apprehension. I read s'where prisoners aren't allowed the privilege of saluting.
