If you were busted for a DUI while active duty, you would have been charged by civilian law and the UCMJ. Every judge is different. I don't think your plan to join the military should have any bearing on a DUI charge in my opinion. I'm also surprised they would let you in with a DUI when they've been hammering down on those. <br /><br />Also a DUI is not a "mistake." It's a choice. A mistake is forgetting to pick up your dry cleaning or making a typo. Choosing to drive while intoxicated is not a mistake - and yes it is very serious. That is how my uncle died two weeks after he graduated high school - and four of his friends with him. Some punk ass 16 year old drunk driving. I never met my uncle because of that kid's foolish choice. My mom lost a brother, my grandpa lost a son five months after losing his wife to cancer. After you enlist. Playing the "I'm joining the military" card to try and get out of any sort of issue speaks of your personal ethics. I hope the recruiter took that contact sheet and feed it to the trash can monster. Don't just think to volunteer your time to the military will get you out of anything.
