I just finished my retirement packet last week, but suddenly I recieved a Flag ( Adver Action). Short Story, While taking to an LT, she said I yelled and disrespected her. I do have the Soldier that were present make sworn statements of the incident and truly not what she claims, but anyways...
CAN I STILL SUBMIT MY RETIREMENT PACKET WHILE FLAGGED OR WILL IT STOP IF ALREADY SUBMITTED?

In essence, yes the FLAG will stop your packet. AR 600-8-2, Section 3-1, Subsection H (however, keep reading the subsections to H).

yes, I did talk to IG and will be heading to TDS Tomorrow. for right now its just a flag for adverse action, but i know they submitted documents to higher for review/referral for article 15. I'm just worried of the outcome. I just want to retire peacefully, but seems like her word was taken right away and i have no say in it. SMH

SFC (Join to see) - What I am able to find...not much, really....regarding suspension (for your case), look in 635-200, sections 1-9 and 1-19. Again, pretty vague to me. Hence why I say go talk to Trial Defense

I am not trying to trivialize anything. But you are retiring. This seems like a juice not worth the squeeze situation, unless there was more than just a shouting match.
We have General Officers and Colonels sexually assaulting and harassing LTs and retiring with no action against them. I can hardly see a need to hold up your retirement for a shouting match.
If you were sticking around, different story. But you have already dropped your packet. Stick you in the G3, under the watchful eye of a crusty SGM, give you meaningful but routine work until you retire, and be done with it.
But that's just me.
