I'm currently I'm on a temporary profile and awaiting surgery for a osteochondrial defect in a couple months. Last week i was told i would be getting flagged on April 1, 2023 for not taking a ACFT. Im currently on a temporary profile and cannot take? Can they still flag me while on profile?

No. Just no. You, being on a temp profile cannot be administered a Record ACFT. Since you cannot be administered a Record ACFT, you cannot be flagged for an ACFT that you have not taken nor can take. Talk with Legal. In fact, have a chat with IG. The fact that your Command is talking about future flagging you for something you cannot medically do....that's just dumbassery

This is something your Commander, or in fact anyone in the S shop should know, very basic thing. I would talk with IG first, that should be enough, if not, go Legal.

One modification first - WHO is telling you that you're going to get flagged? Is it your unit commander or other leadership? Is it your Platoon Sergeant? Some other NCO that saw a unit memorandum that said, "Soldiers who don't have an ACFT by 1 APR 23 will be flagged."?
Whoever is telling you that is wrong, but from the limited information you gave, I'm not ready to throw your unit leadership under the bus for that. Make sure you get the answer from the people that can actually do something about it
If you go straight to the IG, the first question they should ask is if you've tried to handle this through the chain of command and if you didn't, why you didn't.

COL Randall C. - The one thing I do not miss is all the 'word of mouth policies' created in the 30 years since my enlistment. AMEDD was particularly bad about following them and that is sad considering our careers are based off evidence based practice in literature less than five years old and they cannot look up a regulation?

My advise, talk to:
1) Squad Leader,
2) Platoon Sgt,
3) Platoon Ldr,
4) First Sergeant,
5) Company Cdr,
6) Bn/Bde/Div SGM/CSM
7) Bn/Bde/Div Cdr
8) JAG and as a last resort,
9) IG.
Normally someone in your chain of command will get it straightened out, especially if it has to hit the SGM/CSM level.

"Last week i was told"
Let me guess this was a training room, Squad leader, Section leader or PSG that told you this?
Not a commander or 1SG, who knows without a doubt they can not force you to take a fitness test while on a physical profile for a physically limiting condition. (A positive profile does not automatically excuse you from a ACFT, but most do....if you have a profile for not driving at night as an example, that would not exclude you from a record ACFT)
Ask to speak to your 1SG, and tell that 1SG you are looking forward to being healthy and taking your record AFCT.......and then........Eat right, train as you are able to, and recover from surgery with a mission mind set..then smash the AFCT.
