SSgt Christophe Murphy - Contrary to popular belief, conduct unbecoming only applies to officers. Article 133 to be precise, there's still plenty of articles that cover all sorts of actions, and then there's always 134. Conduct unbecoming an NCO/Soldier/whatever is not actually an article of the UCMJ though. That said, yeah if he wants to refuse an order they can get him if they want to, too easy.

SPC (Join to see) - Then they will insert article 91 for the same behavior. The result is the same

SSgt Christophe Murphy - Definitely, he shouldn't be playing games right before getting out.

CPL (Join to see) a Soldier accepts extra duty when you accept the Article 15 over Court Martial. But if they want to play hard ball the commander can retain the Soldier past ETS for a court martial for 30 days and the General can extend them indefinitely once the charges have been preferred

I had a guy get a field grade 5 days before his chapter separatiin date. He lost 1 rank, half of the months pay, and extra duty for 4 days. Day 5 he was gone. You play stupid game you win stupid prizes.
