Do I have to be at high risk for my Husband to take his 21 days of Maternity/Paternity Leave ? We are dual military btw?

Look that will be up to his CoC. If you are having problems, then you need to get paperwork for your provider for him to his CoC

Are you two not at the same duty station? That I could understand. One of my Soldier's wives will be giving birth in the next two weeks and there's no issue with him taking paternity leave or having to submit an ETP. As long as everything is local, there should be no problem.
