Can I continue/begin a Conditional Release while on Title 10 COADOS orders? Can I get the command to which I am attached to release me?

They repeatedly "lost" my conditional release packet and all of a sudden said I had to give it up if I wanted to go on Active orders. Was considering IG, but figured I can avoid all that jazz if the unit I am currently attached to was able & willing to release me instead of my home unit. Is there any policy that I can find loopholes for in regards of WHICH command had to release me? Thank you.

SPC Alan Hunter from all my prior experience if you're on a set of "active duty" orders if you changing from a Reserve To an Active status Soldier you're gonna have to come off the first set of orders before you can go on active duty regardless of which unit. From what you've indicated it sounds like you need to go thru your home unit. Who the "they" are is important. You can always try your Commanders Open Door policy. Good Luck! And be sure to keep personal hard copies of all your Service paperwork! They can't lose if you have proof!

Thanks for the advice. I have tried using the Open Door policy and my commander and my 1SG have expressed full support of me pursuing Active Duty. The issue lies with S-1, due to the fact they keep "losing" my packet every time I submit it, right before they send it to my CO for a recommendation . Periodically, I check the status of my DA 368 and the NCOIC of S-1 always tells me to quit asking or to leave him alone; My platoon sergeant shares this attitude. But as far as I am aware, it isn't their responsibility to determine if I go or not. Once I am informed that my packet is "lost", I resubmit another and get berated by this NCOIC and my Platoon Sergeant.
This process is ongoing. When I requested ADOS orders, the same thing nearly happened but I went straight to the SGM instead and there were no hiccups for ADOS orders (caused me a lot of trouble from my Company, but it was necessary). The NCIOC of S-1 told me he would only do his part to send up my ADOS request if ONLY I gave up my DA 368. Is he overstepping the boundaries , Sir? I apologize for the life story but as on officer, I figured you could point me in the right direction.

SPC Alan Potter it does read a little "fishy" to me. You only briefly mention your 1SG and CSM. What are they and your Platoon Leader saying? IG and congressional are two other routes but I hesitate advising those routes prior to allowing enough wheels to turn. Reserve processing can take awhile due to distances as well as attitudes for approval. The total time you've been pursuing this wasn't mentioned. How long have you pursued this?

Of course, I try to follow the Chain of Command and talk to my line leader, who then talks to the PSG, and so on. But whenever I need something from my PSG or the NCOIC of S-1I never hear back on anything and they tell me to quit asking. So after not receiving an adequate response, I would talk directly to the CO or 1SG and get smoked by this NCOIC or PSG for not "following the Chain of Command". I have been pursuing this since January 2016. I try to trust them and give them weeks without bothering them, but if I follow up I get berated, if I don't follow up nothing happens. Regardless, nothing happens(usually).

I'm sure you have a very good reason why you want to change components, but with the Reserves and National Guard deploying and mobilizing all the time, getting consecutive mob or deploying orders is not that very hard. My last five years in the Army, I had consecutive orders to several stateside and deployments, and I ended up with (11 yrs AD, 9 yrs AR/NG) 20 years serving active duty and 5 years reserve time.

I appreciate the empathy. While it is true that Reserves and Guard deploy often, these deployments are selective and give priority to those with longer time in service. I have been fortunate enough to have been offered multiple ADOS orders (currently on COADOS orders in EUR), Reserve soldiers usually do not have the same opportunities as their Active Duty counterparts. For example, I may never be able to attend Air Assault, Airborne, CLS, Combatives, etc. because they know my time is always much more limited. Being Active Duty will prevent my from being hostage to the Reserve limits. But I'll take what I can get until I get what I want.

Conditional releases to go from the USAR to Regular Army can be tricky. The approval authority is USARC G1, with endorsements recommending approval from your chain of command. Without digging into the regs, if I remember correctly, anyone in your chain of command can disapprove it, they just can't approve it. In other words, your Bde commander can say no but can't say yes. Either way, you should be given an answer and not left in the dark. Download AR 140-10, that is the reg that covers conditional releases. Keep in mind, the USAR is not obligated to release you to go Regular Army, you are under contract.

I was looking for specific regulations to see if I can find a way to workaround the regs, which is very sneaky, but at the same time the circumstances (finance, no career growth due to there not being any E-5 slots for my MOS, over manned unit, and lack of meaningful training) have forced my hand. SGT (Join to see) - Just research this reg and understand the full process, then ask to see your commander under the open door policy to discuss the status of your request for release. Best to have your ducks in a row and know the regs going in. Don't assume that the command knows the process on conditional releases. In my experiences, most of the delays (when approval was recommended) was it getting kicked back by higher for errors or incomplete. The USAR requires a DA 4187 in conjunction with the DD368 because it is a personnel action that requires endorsements.
