So if a Soldier gets 45 days extra duty, does it have to be 45 days in a row or is the Commander allowed to make it M-F with weekends off, thus extending the days to a later calendar date? Please reference your response.

No, days may not be broken apart. The days must be served consecutive.

AR 27-10 (5) Extra duties. Extra duties may be required to be performed at anytime and, within the duration of the punishment, for any length of time. No extra duty may be imposed that-
(a) Constitutes cruel or unusual punishment or a punishment not sanctioned by the customs of the Service; for example, using the offender as a personal servant.
(b) Is a duty normally intended as an honor, such as assignment to a guard of honor.
(c) Is required to be performed in a ridiculous or unnecessarily degrading manner; for example, an order to clean a barracks floor with a toothbrush.
(d) Constitutes a safety or health hazard to the offender, or
(e) Would demean the Soldier's position as a NCO or specialist (SPC) (AR 600-20).

This is what they did to me and I pretty sure they shouldn't be able to do this. I had 15 days ED and 3 of the days I was on quarters due to spine injections, they didn't count those days and added 3 days to the end. I didn't bitch because I won the war, believe me.

Once extra duty starts it runs consecutively until complete - it cannot be stopped and started at the convenience of the command - Check AR 27-10, para 3-21. Once an unexecuted punishment is imposed (IE: Day of second reading) it starts unless legitimately delayed by the commander, such as relocation to a deployed environment - second reading happens, you get on a plane, go to Afghanistan THEN start your extra duty). It can, however, be stopped and started if it benefits the Soldier as stated previously such as for hospitalization or emergency leave. There is no authorization to start and stop it for the benefit of the command. If you have questions about this you should contact your BJA or senior paralegal.

The commander can give the soldier weekends and holidays off, but the 45 days starts when the punishment starts... you can't give them 10 days of extra duty each month until the entire 45 days is served (5 months later)

Well, lol, that would have been my thought, too. Like, I thought weekends off were a "reward" for good behavior... I could see if there was some benefit to the command structure, to only do the "punishment" on weekdays. But otherwise, I'd think it was a foregone conclusion that punishment was supposed to suck, so you didn't repeat the offense. Of course, I was a GOOD CAMPER, and followed orders, etc. I did once get yelled at for rolling my eyes.

I was stationed with a man who rolled his eyes when his staff NCO was correcting him. They got him for disrespect to a NCO.
