The law requires Congressional notification.

No...just another bureaucratic hoop to jump through and MANY of our 'representatives' would have been asking, "What's in it for me for my state?"

The American PEOPLE decide, not Soldiers nor politicians. The People decide the greater/lesser good through our laws.

LTC Tongret,

Yes, in a PERFECT democratic society.

The American people vote for politicians...are you saying that the American people vote directly on these laws?

The American people vote for ideas and promises from politicians...politicians can change their views at anytime without a re-vote.

The President made a good call by getting Bergdahl out of Afghanistan as the war is winding down. Because I'll never know the specifics of the deal and who said/did what, it's hard to say who's/what's right.

MSG Quick,
You are correct. Soldiers and politicians are different. Does that mean politicians get to ignore laws. All laws? All politicians? Or just when convenient?

If politicians are free to ignore the laws (passed by politicians), what does that imply about the nature of our society? This isn't a question that is susceptible to a "better minds must be taking care of it" approach/hand wave if we actually believe that we live in a representative republic.

LTC Stoneking,

I'm not debating any and all laws, but in THIS case, if the President made a case to rescue a POW (no matter the circumstances he got there), that's a good decision in my book.

It is the law, they should have been notified. Regardless weither or not they were notified we just gave the taliban a great victory and ruined any progress we have made in the last 10 years of war in Afghanistan. They now have a great boost in morale, a win over the United States for recruiting propaganda and five of their top leaders back to plan and execute future attacks on our Soldiers and possibly our own soil again. If they wanted to get Bergdahl back they should have sent in a Special Ops team and extracted him by force, they found binladin, they could have found him too. I truly believe this is going to bite us in the a$$ down the road.

Yes it is the law I agree.
We need to nip this before it gets out of hand

So, if I understand correctly, the law says congress must be notified, and the law was broken... not surprised, doubt anyone else is either. Bottom line, SGT Bergdahl is safe. The legal issue can be worked out later... can't really go back in time.
